Pedestrians and motorists both possess duties to safely adhere to road regulations. However, accidents still happen and those involving pedestrians are seldom black and white.
A pedestrian may be considered partially liable if they are unlawfully crossing the road at the time of the incident, also known as jaywalking. The state of California applies comparative liability in these situations. This limits the amount of compensation you can receive based upon the degree to which your own negligence contributed to the cause of your injuries.
Because the insurance company is going to seek out reasons to devalue your injuries, it is best to call upon an experienced personal injury attorney to explore and identify your options.
If you have been injured in a pedestrian accident while you were jaywalking, you may still be entitled to compensation. Seeking medical care as soon as possible is crucial in terms of protecting the value of your personal injury claim and properly treating the injuries you’ve sustained from the accident.
The right attorney will stand by your side and fight to get you a fair settlement.
