A 59-year-old man was struck and killed by a sedan outside of Dixon on Monday morning.

The man was driving a white pickup truck eastbound on I-80 in the far-right lane when a ladder fell off of his truck. The man pulled over to the right shoulder, drove in reverse toward the ladder, then exited his truck.

He was attempting to retrieve the ladder on foot when an oncoming Toyota Camry struck him. The driver of the Camry stopped and attempted to help the victim until emergency services arrived.

The victim succumbed to his injuries and was pronounced dead at the scene.

Both drivers and pedestrians have a duty to act safely and conscientiously on the road. Failure to do so dramatically increases the chance of a tragic accident occurring.

Even if the pedestrian is found to be partially at fault for an accident, due to the doctrine of comparative liability their family may be able to receive compensation in a wrongful death claim.

It is understandable that in the time after an accident, you want to be able to grieve with your family without worrying about insurance companies or legal issues. Having the right personal injury attorney on your side will allow you to do so in peace, while at the same time ensuring that your family receives a settlement that will see you through this difficult time.

At Bergener Mirejovsky, we understand that no amount of compensation can make up for the loss you have suffered, but we hope that it can ease some of your worries. Our team will treat your loved one’s case with the respect it deserves.

We are available to offer you a free strategy session at any time of the day, any day of the week. Call 1-800-881-2021 to discuss your case with a member of our team and have your questions answered.
